In January 2026, the U.S. government began a Refugee Detention Policy where they started arresting and detaining refugees in Minnesota who have not yet gotten legal permanent resident status (or “green card”).
On January 24, 2026, a group of refugees filed a class action lawsuit to stop this Refugee Detention Policy. If a judge agrees with this lawsuit, the court’s decision could apply to all refugees living in Minnesota who do not have their green cards and could be detained under the Refugee Detention Policy. Refugees could still be detained by ICE if there is a separate legal reason to deport that person.
